Wages

1

Wages and how they're paid

Arts. 88–90
A monthly wage is paid once every month (Article 90), through approved banks (Wage Protection System). It may not be delayed without a legitimate reason. When service ends, dues are settled within one week if the employer ends the contract, and within two weeks if the employee resigns.

Leave

7

Annual leave

Art. 109–110
21 days for less than 5 years of service, and 30 days once you complete 5 years. Leave is on full pay, paid before it starts. Your employer may postpone it after the end of the year it's due by up to 90 days if work requires it; anything longer needs your written consent, and no later than the end of the following year (Article 110).

Maternity leave

Art. 151, 155
A female employee is entitled to 12 weeks with full pay (6 of them mandatory after delivery). If the child is ill or has a disability: one extra month with pay. She may extend by one month without pay. She may not be dismissed during pregnancy or maternity leave.

Paternity leave

Art. 113
An employee gets 3 days with full pay when his child is born, taken within 7 days of the birth.

Sick leave

Art. 117
The first 30 days on full pay, the next 60 days on three-quarters pay, and the 30 days after that without pay — within one year, counted from your first sick leave.

Bereavement and family-event leave

Art. 113
5 paid days on the death of a spouse, parent or child. 3 days on the death of a brother or sister. 5 days for marriage. All of these are fully paid.

Hajj leave

Art. 114
You are entitled to Hajj leave once during your service, with full pay, of no less than 10 and no more than 15 days, provided you have completed two years of service.

Exam and study leave

Art. 115
An employee enrolled at an educational institution with the employer's approval is entitled to fully paid leave for the actual exam days. Without approval, the days are taken from annual leave.

End of Service

1

End-of-Service Award

Art. 84–85
When the contract ends, the employee is entitled to half a month's wage (actual wage: basic + allowances) for each of the first five years, and a full month's wage for each year after that. On resignation (Article 85): under 2 years, nothing; from 2 to 5 years, one third; more than 5 to under 10, two thirds; 10 years or more, the full award.

Working hours

1

Working hours and overtime

Arts. 98–107
The maximum is 8 hours a day or 48 hours a week. During Ramadan, for Muslims: 6 hours a day. Overtime hourly pay = the hourly rate from the total wage + 50% of the basic hourly rate.

Dismissal and resignation

3

Termination notice

Art. 75–76
Indefinite-term contract with a monthly wage: the employee gives 30 days' notice and the employer gives 60 days' notice; if the wage isn't monthly, notice is 30 days for both (Article 75). A party that doesn't observe the notice period pays the other party compensation equal to the wage for the missing part of the notice (Article 76).

Unfair dismissal

Art. 77
An employee is entitled to compensation if the contract is ended without a legitimate reason. If the contract doesn't set the compensation: in an indefinite-term contract it is 15 days' wage for each year of service, in a fixed-term contract the wage for the remaining term, and in both cases no less than two months' wage.

Dismissal without compensation

Art. 80
An employee may be dismissed without an award, notice or compensation in specific cases, after being given the chance to state their objections. These include assaulting the employer, disclosing secrets, proven forgery, and unexcused absence of more than 30 days in one contract year or more than 15 consecutive days, provided a written warning is given first (after 20 days of absence in the first case, and 10 days in the second).

General provisions

2

Probation period

Art. 53
It may not exceed 180 days, under the latest Labor Law amendments. Neither party is owed compensation if the contract ends during it, and no end-of-service award is due.

The employer's legal obligations

Art. 61, 64, 122
The employer must: treat the employee with respect, provide a safe work environment, issue a free service certificate at the end of employment, return all documents and certificates, and not discriminate.
